1. Overview of Membership
The Program is a paid membership that provides access to discounts and promotional offers (“Offers”) from participating local businesses (“Partner Businesses”).
By purchasing or using a membership card (digital or physical), you (“Member”) agree to these Terms & Conditions.
2. Membership Purchase and Term
- Memberships are sold for a fixed term (e.g., 12 months) unless otherwise specified at the time of purchase
- Membership begins on the date of activation or purchase, as determined by the Company
- Membership fees are non-recurring unless explicitly stated
3. Pricing and Payments
- Membership pricing is set by the Company and may change at any time for new purchases
- All payments must be made in full at the time of purchase
- Applicable taxes may be added as required by law
4. Use of Membership
- Membership provides access to Offers at participating Partner Businesses
- Offers may be used multiple times unless otherwise stated
- Member must present a valid digital or physical card at the time of purchase to redeem an Offer
- Membership is for personal use only and may not be shared, transferred, or resold
5. Partner Business Offers
- Each Partner Business sets its own Offer and any applicable restrictions
- Offers may include percentage discounts, BOGO deals, or free add-ons
- Some exclusions may apply (e.g., alcohol, holidays, special events), and will be disclosed when available
The Company does not control pricing, inventory, or service quality at Partner Businesses.
6. Changes to Participating Businesses
- Partner Businesses may join or leave the Program at any time
- Offers may change, be modified, or discontinued without notice
- The Company does not guarantee that any specific business will remain in the Program for the duration of a membership
7. No Guaranteed Savings
The Company does not guarantee:
- A specific level of savings
- Frequency of Offer availability
- That the membership will result in financial benefit
Value depends on individual usage and participating businesses.
8. Refund Policy
- All sales are final unless otherwise stated at the time of purchase
- Refunds may be issued at the Company’s sole discretion in limited circumstances (e.g., technical issues, duplicate purchases)
- Requests must be submitted within [7–14 days] of purchase
9. Lost, Stolen, or Damaged Cards
- Members are responsible for safeguarding their membership card
- Lost or stolen cards may be replaced at the Company’s discretion and may incur a replacement fee
- Digital memberships may be reissued if account ownership can be verified
10. Proper Use and Conduct
Members agree to:
- Use Offers honestly and as intended
- Not attempt to duplicate, share, or misuse membership credentials
- Treat Partner Businesses and staff respectfully
Misuse may result in suspension or termination of membership without refund.
11. Limitation of Liability
To the fullest extent permitted by law:
- The Company is not responsible for disputes between Members and Partner Businesses
- The Company is not liable for any damages, losses, or dissatisfaction arising from products or services provided by Partner Businesses
All transactions with Partner Businesses are solely between the Member and the business.
12. Indemnification
Members agree to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from:
- Misuse of the membership
- Violations of these Terms
- Interactions with Partner Businesses
13. Modification of Terms
The Company may update these Terms at any time.
Continued use of the membership after updates constitutes acceptance of the revised Terms.
14. Termination of Membership
The Company may suspend or terminate a membership at any time for:
- Violation of these Terms
- Fraudulent or abusive behavior
No refunds will be issued for terminated memberships due to misuse.
15. Privacy
The Company may collect and use Member information in accordance with its Privacy Policy.
Personal information will not be sold to Partner Businesses without consent, except as necessary to provide Program services.
16. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
